The results of this Project contains one copy of analysis for the subject matter, one copy of reference sample in Chinese and the English Translation of the tender document and concession agreement for BOT projects. It is also to be noted that the translation of reference samples of the tender document and concession agreement as provided under this Project are prepared based upon the 2009 project of the Public Construction Commission of Executive Yuan titled, “Samples of Tender Document and Concession Agreement for Promotion of Private Participation”. It is hoped that the English translations of the Tender Document and the Concession Agreement will promote the internationalization of BOT projects, deepen foreign investors’ understanding and recognition of the legal environment for private participation in public projects in the R.O.C. Furthermore, by accelerating the integration of foreign investors into the investment activities of BOT projects in the R.O.C. and thereby creating a friendly impression of the R.O.C. internationally, it would attract and encourage further foreign investments.
The documents proposed hereunder should only provide reference to the relevant competent authority for application in private participation cases. Furthermore, the contents of the proposed documents should not be applied in its entirety to all types of private participation cases. The government and competent authority shall consider the rationale and relevant necessities of each case by evaluating the type of infrastructure and characteristic of each case and make amendments accordingly.
